I cannot send it through this website because he will get tons of calls, which would burn that relationship. You will need to call me, and you can find my phone number at www.TeamForYOUrDreams.com . Your attorney is right. Tim Burrell

Can you send me your contact # or the contact at BofA. My attorney is trying to go up the chain but she says they are the most arrogant folks she has ever dealt with.

Well thought we had a confirmed contract and we only needed to push out the closing date. but.... whoever at BofA did the final review is insisting on adding the ex-husband back to the deed. Same spot we were in 3 months ago. My attorney and (several others) have told me that is totally unnecessary and could possibly be considered mal-practice to add someone with known judgements back to a deed. One last shot at trying to find someone at Bofa that can make a decision. I have been told that person doesn't exist..I would recommend anyone looking to get a short sale at BofA should just walk away while they can.

Yes, lots of short sales involve sellers who are getting divorced. Huge financial problems cause huge relationship problems. I had one where a judgment against the ex-wife showed up a week before closing and messed up the sale. It sounds like you are getting there. I find it interesting that the negotiator at Bank of America wants to practice law by giving legal advice on how to handle this sale. Good luck.

I am glad to se that someone dealing with BofA has closed. We made our offer in February 2011 and were told it went to the investors last week August 15th. Our biggest delay was because the note is in the ex-husbands name and the deed (quit-claim) is in the ex-wife's name. Our 2nd negotiator insisted that our attorney add the ex-husband's name back to the deed. My attorney refused because the husband had many judgements that would attach to the house. I was also told that the wife had judgements attached to the house. My agenst urged me to find an attorney that would comply but we refused. The contract was thrown back and we re-submiited at a lower price and agreed to cover the judgment of $11,000 attached to the deed. This time the new negotiator said sure 'there is a form you need to fill out when deed/note are in dfferant names' So we are waiting to see if this 'master agreement' which was attached to the file will really satisfy the issue with the deed. Since they passed it on to the investors we hope we will get an answer soon. This must be a common situation as many short sales seem to involve a divorce. Has anyone one else been in this situation?

We are really hoping that you're right, and it still happens. We are not in the best living situation (family conflict) and it's about to get worse. But thank you for your help. Hopefully I will soon be able to let you know that everything worked out!
